Most of today’s laws in many nations are derived from either civil law or common law which in turn got most of its principles from canon law and Roman law. Canon laws of the Catholic Church, in combination with ecclesiastical law of the Eastern Orthodox Church and the Anglican Church of England, form the oldest continuously existing (still functioning) legal system today. With Christianity as the largest religion today in terms of number of adherents, canon law has widespread significance in contemporary society and more so in Western hemisphere cultures.

Modern societies cannot function if laws do not exist. These laws could be codified or not. Our laws exist for our individual protection and also to benefit society as a whole. This is why we say the “rule of law” must prevail at all times in all situations. Many legal concepts we take for granted today were adopted from Islamic jurisprudence such as presumption of innocence, contracts for agency, laws on limited partnerships, legal transfer or assumption of debts, and the doctrine of final judgment. All of them were based on the most fundamental principles of law and society in general: equity and good faith.

Laws can be said to be derived from antiquity when Man first learned to live in communities. Canon law is the source of most common laws and civil laws and later penal laws. A country’s common law is developed by its customs (common practices) while civil law originated primarily from Roman law with Germanic influences. This is why civil law is sometimes called as the Romano-Germanic Law.
